Murder and Manslaughter
Murder and manslaughter are serious criminal offences under the Crimes Act 1900 (NSW). While both involve the unlawful killing of another person, they differ in the level of intent and recklessness. What must the Prosecution Prove?
For murder, the prosecution must prove:
- The accused intentionally caused the death of the victim or acted with reckless indifference to human life.
- The accused had the necessary intent or was committing another crime during the death (e.g., robbery or assault).
For manslaughter, the prosecution must prove:
- The accused caused the death, but without intent to kill.
- The act was reckless or negligent (e.g., dangerous driving or failure to provide care).
Penalties
- Murder: The maximum penalty is life imprisonment.
- Manslaughter: The maximum penalty is 25 years imprisonment, depending on the circumstances and the level of recklessness.

Defences include:
- Self-Defence: The accused acted to protect themselves or another person.
- Lack of Intent: The accused did not intend to cause death or serious injury.
- Criminal Negligence: The accused acted in a way that fell far below a reasonable standard of care, leading to the victim’s death.
