The Early Appropriate Guilty Plea (E.A.G.P) process is designed to expedite the resolution of criminal cases by encouraging early pleas where appropriate. The EAGP committal process makes its way through the Local Court prior to advancing to the District Court or higher for Sentence or Trial. This process can be a lengthy one and we ensure you are supported and guided every step of the process. During this process, we negotiate to have serious charges withdrawn early.
How the E.A.G.P Process Works
There are 4 main stages in the E.A.G.P Committal process:
- Service of Evidence: The prosecution have an obligation to serve all relevant evidence which the prosecution intend to rely upon in proving the offence. This enables the defence to assess the strength of the prosecution case and make informed decisions about our advice to you about negotiation and/or defence strategies.
- Charge Certification (withdraw charges lawyers): This stage involves the prosecution reviewing the evidence and charges, and determining if they proceed on the original charges, add additional charges, add alternative charges, or withdraw charges.
- Case Conferencing: The prosecution and defence meet to discuss the charges, evidence, and potential outcomes. The aim is to negotiate a resolution which is in the best interest of the client, this can include a complete withdrawal of the case, plea deals or a negotiated early guilty plea where discounts on sentence apply.
- Committal: At this final stage of the committal process in the Local Court, both parties advise the Local Court whether an appropriate guilty plea was agreed upon. If a plea of guilty is entered, the matter will be Committed to the District Court for Sentence. If a plea of not guilty is entered, the matter will be Committed to the District Court for Trial.
